Terms of Service
CanvaScreens is operated by BuiltPOS LLC. Last updated: 3 September 2026
In short
You pay a monthly fee, we run the console and keep your screens fed. You own your content and your menu data; we only ever use it to run the service for you. You are responsible for what the screens display, including whether the prices and calorie counts coming out of your point of sale are correct.
Either side can end the agreement with 30 days' notice. If we miss the uptime commitment you get service credits. Our financial liability is capped at what you paid us in the previous twelve months.
1. Who this agreement is between
This agreement is between CanvaScreens ("we", "us") and the business that signs up for an account ("you"). It takes effect when you create an account or first use the service, whichever happens first.
If you accept these terms on behalf of a company, you confirm that you are allowed to bind that company. If you bought CanvaScreens through a reseller, these terms still govern how the service works; your reseller's contract governs what you pay and to whom.
2. What we provide
A hosted digital signage management console at app.canvascreens.com, a device API at api.canvascreens.com, and player software for the devices attached to your screens. You use it to design menu boards, organise them by location and time of day, connect a point of sale so prices and items stay in step, and see what each screen is doing.
We improve the product continuously. Features may be added, changed or retired. If we remove a feature you actively use, we will give you at least 30 days' notice by email.
3. Accounts and access
- Give us accurate account details and keep them current.
- Keep credentials private. Everything done under your account is treated as done by you. Turn on two-factor authentication; it is available on every account at no charge.
- You are responsible for the people you invite, including staff, contractors and any agency working on your boards.
- Tell us promptly if you think an account has been compromised so we can revoke its sessions.
4. Your content
Your images, video, layouts, menus, location data and everything else you put into CanvaScreens remain yours. We claim no ownership of any of it.
You grant us a non-exclusive licence to store, copy, transmit, reformat and display that content strictly for the purpose of running the service for you — pushing it to your devices, showing you previews in the console, and backing it up. That licence ends when the content is deleted, allowing for the short period it persists in backups.
You confirm you have the rights to everything you upload. Fonts, stock photography, music, brand logos and franchise artwork all carry licences, and those licences are yours to hold. We do not clear them for you.
5. Point of sale connections
If you connect Toast or Clover, you supply credentials for your own merchant account and authorise us to use them to read your menu. We read item names, categories, prices, availability, descriptions and calorie counts, and nothing else. We do not request or use access to orders, guests, staff or payments.
You can disconnect an integration at any time in the console, which stops the syncing immediately.
6. What your screens display
You are responsible for everything shown on your screens. That includes the accuracy of prices, the accuracy of calorie and nutritional information, allergen statements, and any disclosure your jurisdiction requires on a menu board — including US federal menu labelling rules where they apply to you, and any state or local rules on top of them.
We give you the tools to publish this information quickly and to see what each screen is showing. We do not check whether it is correct or compliant, and we cannot.
Your content must also comply with our Acceptable Use Policy, which forms part of this agreement.
7. Devices, networks and hardware
You buy your own screens and streaming devices. We support the player software running on them; we do not warrant the hardware, and a failed TV or streaming stick is not a service outage.
You provide the internet connection at each site. A screen with no network keeps playing the content it already holds, but it cannot receive changes, sync menu updates or report its status.
8. Fees and billing
- Subscriptions are billed in advance for each period through Stripe. Prices are those published or quoted at the time you subscribe.
- Where a plan is priced per screen, adding screens increases the fee from the next billing period.
- Fees exclude sales tax, VAT and any other applicable tax, which is added where required.
- If a payment fails we will retry and email you. If it remains unpaid for 14 days we may suspend the console. Screens continue playing their last content; they simply stop receiving changes.
- Fees are not refundable for a partial period, except where the law says otherwise or where we have failed to deliver.
- We will give at least 30 days' notice by email before any price increase. If you do not accept it, cancel before it takes effect.
Card details are entered with Stripe and held by Stripe. We never see or store a full card number.
9. Trials
If we give you a trial, it runs for the period we state and can be ended by either side at any time. Trials are provided as they are, with no uptime commitment and no service credits.
10. Ending the agreement
You can leave
Cancel in the console or by emailing us. Cancellation takes effect at the end of the current billing period; we will not bill you again after that.
We can suspend or terminate
We may suspend or close an account for non-payment after notice, for a breach of the Acceptable Use Policy, or immediately where content or activity is illegal or presents a security risk to other customers. Where we can safely give notice first, we will.
What happens after
Screens stop receiving new content and stop syncing menus. They will keep displaying whatever they last received until they are unplugged or repurposed. Your data stays available for export for 30 days after closure, after which it is deleted as described in the Privacy Policy.
11. Availability
Our uptime commitment, how it is measured, what is excluded and what you get if we miss it are set out in the Service Level Agreement, which forms part of this agreement. Service credits are your only remedy for a failure to meet that commitment.
12. Third-party services
Stripe, Toast and Clover are independent companies with their own terms. When you connect one, you are also agreeing with them. If one of them changes an API, raises a price, throttles requests or goes down, we will work around it where we can, but we are not responsible for their acts or omissions. The complete list of companies that process data for us is on the subprocessor page.
13. Our intellectual property
The console, the API, the player software, our templates, our documentation and the CanvaScreens name and marks remain ours. You get a licence to use them for the term of your subscription, and nothing more. You may not copy, resell, sublicense or reverse engineer the software except where a law gives you that right regardless of this clause.
If you send us an idea for improving the product, we may use it without owing you anything for it.
14. Confidentiality
Each side will keep the other's non-public information confidential, use it only for this agreement, and protect it with at least reasonable care. This does not cover information that is already public, was already known, is independently developed, or must be disclosed by law.
15. Warranties and disclaimer
We warrant that we will provide the service with reasonable skill and care, and in a way that materially matches our published documentation.
Except as expressly stated in this agreement, the service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that data supplied by a third-party point of sale will be accurate.
16. Limitation of liability
To the fullest extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost sales, loss of goodwill, or loss or corruption of data, however caused and under any theory of liability, even if that party was advised of the possibility.
Each party's total aggregate liability arising out of or relating to this agreement will not exceed the total fees you paid us in the twelve months immediately before the event giving rise to the claim.
These limits do not apply to your obligation to pay fees, to either party's indemnity obligations, to a breach of confidentiality, or to anything that cannot lawfully be limited, including fraud, wilful misconduct, death or personal injury caused by negligence.
17. Indemnity
You will defend and indemnify us against third-party claims arising from the content you display, from menu or nutritional data you publish, from your use of the service in breach of this agreement or the Acceptable Use Policy, and from your infringement of anyone else's intellectual property.
We will defend and indemnify you against third-party claims that the CanvaScreens software itself infringes their intellectual property.
18. Changes to these terms
We may update these terms. For material changes we will email account administrators at least 30 days before they take effect. Continuing to use the service after that date means you accept the new version. If you do not, cancel before it starts.
19. Governing law and disputes
This agreement is between you and BuiltPOS LLC, which operates CanvaScreens. It is governed by the laws of the State of Delaware, without regard to its conflict of laws rules, and the state and federal courts located in Delaware have exclusive jurisdiction. Each party waives any objection to that venue. Either party may still bring a claim in a small claims court that has jurisdiction.
Before filing anything, email us and give us 30 days to sort it out. Most disputes are a misunderstanding about an invoice and are settled in one reply.
20. General
- Notices. We will email the administrators on your account. Write to us at hello@canvascreens.com.
- Assignment. Neither side may assign this agreement without the other's consent, except to a successor in a merger or sale of substantially all assets.
- Force majeure. Neither side is liable for a failure caused by something genuinely outside its control, such as a datacentre failure, a network outage, war or a natural disaster.
- Severability. If a clause is unenforceable, the rest stands.
- No waiver. Not enforcing a term once does not give it up.
- Entire agreement. This document, together with the Acceptable Use Policy, the Service Level Agreement and the Privacy Policy, is the whole agreement between us on this subject.
- Independent contractors. Nothing here creates a partnership, agency or employment relationship.
